Commission is applicable only on cargoes defined in section (F,G, H) of tariff no. 5 and is charged in addition to the agency fee as per Tariff No. 1.

a)   Primage is only applicable on cargo loadings defined in section (F,G,H) of Tariff No.5 and is charged in addition to the agency fee as per Tariff No. 1.

 

b)    However, the amount of primage to be charged per bill of lading, is limited with 3.500.- Euro.

 

OTHER AGENCY SERVICE FEES

  1- Spare Parts:

1.00 Euro of agency service fee will be paid to the agent for each consignment or consignment sender per kilo of the total weight of spare parts and/or stores forwarded from foreign countries that is delivered to the vessel. The service fee charged per each passage or call is minimum 150.- Euro and maximum 500.- Euro , in addition to delivery expenses.

 

 2- Bunker Supply:

Bunker supply and slop delivery attendance fee of 250.- Euro is charged in case the service is rendered to vessel at anchorage.

 

3- Per person who embarking or disembarking during passage through Turkish straits

STEVEDORING:

Either of the following two alternatives to serve as a basis of agency contract terms between Owners and Agents when the loading and discharging expenses are for owners account. (Liner terms – Berth terms)

a)    LUMPSUM SYSTEM:

For usual break bulk cargo not carried in containers, lash, Ro Ro and other systems, services of loading / discharging and/or shifting within the vessel are chargeable as follows:

b)    COST PLUS FEE:

The agent debits the owner by adding the fees as per terms of this special agreement on to the cost of port monopoly’s or other invoices or expenses.

The following surcharges must be taken into account in the above operations of discharging / loading and shifting.

1-  Apart from the cargo being loaded or discharged in to the ship’s holds; if the already loaded cargo in the same hold or the hold itsef dirties the stevedores clothes and human skin, or need a cleaning well beyond the normal standards, due to dirtiness or polluting nature thereof 30 percent surcharge is applied to the basic rates fort he amount of cargo actually loaded, discharged or shifted.

 2-  Discharging of any vessel which lost its normal positions in consequence of heavy weather or causualty is subject tp 30 percent surcharge. 

3-  Discharging of heavy weather damaged cargo (i.e. wet, scattered etc.) subject to 30 percent surcharge. 

4-  20% is charged in addition to the regular charges in the handling of Dangereous goods (IMO)

Opening / Closing Hatches and Rigging:

STANDBY

In case of keeping the personel vehicle and tools assigned by the Administration upon the request of client to execute loading, unloading, shifting and transhipment services in standby for the reason mentioned general basis of the tarif, for each gang which includes the employees and workers on duty in such gang (including the personel of the sea  craft) and machinery and tools assigned to effect the services, a fee of EURO 25 for each hour and fraction of.

 TRANSHIPMENT For each transhipment in addition to the co sts:  1 EURO per freight ton and minimum 70 EURO

FUNDS FOR DISBURSEMENTS:

In accordance with Exchange Control requirements Owners are obliged to remit all ships disbursements in advance of the vessels arrival in foreign Exchange.

Such funds should be received by the agents anyhow before vessel’s departure.

Should the Owners or Disponents delay to remit requested funds until the departure of the vessel, agents have the right to charge a disbursement commission of 2,5 % on monthly basis.

The undermentioned tarif has been issued by Ministry of Environment and Urbanisation and published in the Official Gazete No.29931 dated 39th December 2022 related with the Law No. 32058 Article 20.

The administrative fine to be applied in case of discharge of hazardous substance and waste shall be imposed in tenfold, considering such waste substances in the category of petroleum and derivatives.

 Following sea polution, if it is seen that the vessel or sea vehicle has removed such polution by herself, the administrative fine shall be applied as 1/3 of the usual amount.

 If the fine is not paid up immediately at once, or if no sufficient guarantee is given regarding such matter, the vessels or other sea vehicles that can be towed shall be taken and delivered to the nearest port authority, and shall be banned from sailing and any activity. The letter of guarantee by a bank or issued by the club underwriter of the vessel may be accepted as guarantee.

In case Turkish flagged vessels violate the legislations of any other country in its territorial waters, if such country does not apply any penalty and requests Turket to apply penalty, the provisions of this Law shall apply.
